Terms & Conditions
|
These general terms and conditions apply to all Ticket Orders made with worldcupticketservice.com (Global Tickets) for the football world cup 2010 in South Africa by an individual or corporate or other entity (hereafter referred to as the Client).
1. NON-AFFILIATION:
The Client is aware that Global Tickets is an independent intermediary acting in the secondary market. Global Tickets is in no way affiliated with, connected to or cooperating with world cup 2010 and or FIFA.
2. PAYMENT:
Client's payment must be made by wire transfer, credit card (Visa or MasterCard) or cheque. All payments are non-refundable. Failure to have made correct payment to Global Tickets on the due date as set out in the Ticket Order, constitutes material breach of contract and the Ticket Order will automatically be cancelled by Global Tickets without prejudice to any other remedy it may have.
3. PRICE:
All tickets are sold at face value plus an additional amount representing the fair compensation for the costs, financial risk, work and difficulties involved in obtaining the required seating at the FIFA 2010. All prices are inclusive of this additional charge.
4. ORDER GURANTEE:
All tickets sold by Global Tickets are guaranteed authentic. All tickets sold by Global Tickets will be delivered according to specifications in order and terms and conditions.
In case of failure by Global Tickets to deliver according to above and according to our terms and conditions for any reason, Global Tickets will pay and return a sum equal to 105% of any deposits and/or payments for undelivered tickets. Compensation in addition to paid amount shall not, however, exceed EUR 1000 per Contract or Customer.
5. DELIVERY:
Global Tickets will deliver the tickets according to these Terms and Conditions and the order guarantee.
Due to security reasons FIFA / Worldcup 2010 prints and distributes tickets no earlier than three weeks prior to the game. Therefore the tickets will normally be sent by post or courier approximately 7-10 days prior to the relevant game. The Client accepts that due to possible delays, Global Tickets have the right to deliver tickets up to 24 (twenty-four) hours before the relevant game.
If Global Tickets has not sent the tickets by post or courier by the end of the seventh (7.) day before the relevant game, the Client can up until four (4) days before the relevant game provide Global Tickets with a local address / hotel address in the city of the relevant game in South Africa where the Client will pick up the tickets, see clause 5 below. 6. CONTACT DETAILS:
The Client shall by email or fax provide Global Tickets with any change of contact details, including whereto the tickets shall be sent, after the date of the Ticket Order. See also clause 4 above regarding local delivery address in South Africa. Such change of contact details shall be sent by email: contact@worldcupticketservice.com.
Global Tickets is not responsible for the Client's non-receipt of tickets or returned tickets due to lack of information from the Client.
7. REQUIRED INFORMATION:
The parties acknowledge and accept that for security reasons it is essential that the name, address and passport number of each ticket user shall be available for the relevant policing authorities. Global Tickets shall have the right to demand such information and the Client shall upon such demand immediately furnish Global Tickets with the requested information. Client's failure to provide requested information will result in the non-delivery of ordered tickets, and all payments made by the Client shall be non-refundable.
8. ENTRANCE TO THE MATCHES:
Global Tickets urge the Client and all ticket holders to read FIFA's terms and conditions for the world cup 2010.
Global Tickets assumes no responsibility for ticket holders being refused entry to a stadium/match due to non-compliance by the Client with the terms and conditions set by FIFA for entry to the stadiums.
9. RESTRICTIONS ON USE:
Use of the tickets for promotional activities, such as, but not limited to games, lottery or competitions, is prohibited. The Client undertakes to inform each of the final ticket users of this limitation.
10. CANCELLATION BY YOU: No refund is made for cancellation/amendment of bookings at any time after your order is confirmed and if still cancellation is there in that case customer needs to pay 25% cancellation fees and if incase tickets are ready for dispatch customer have to pay 50% cancellation fees over the total invoice.
11. INDEMNIFICATION:
The Client shall indemnify and hold harmless Global Tickets and each of its employees and directors from and against all or any claims, liabilities, costs, damages and expenses (including reasonable legal expenses) by reason of or arising out of Global Tickets provision of tickets to Client which its suppliers have provided or sold to Global Tickets or through Global Tickets in breach of contract with FIFA Worldcup 2010 and/or other official agents or in violation of applicable law.
12. NO LIABILITY:
Global Tickets provides tickets only, and shall not be held liable for or pay any form of compensation in the event of postponement of a game or cancellation of entire or parts of games or the entire tournament. In cases of loss or theft or similar, the tickets will not be replaced or reimbursed by Global Tickets.
To the extent permitted by law, Global Tickets hereby excludes all other warranties, conditions and representations than those expressly provided herein. Global Tickets shall in no event be liable for any indirect loss or damage and Global Tickets liability shall not exceed the payment made for the relevant Ticket Order.
13. LAW AND JURISDICTION:
The relationship between Global Tickets and the Client shall be governed by and interpreted in accordance with Norwegian law, and the parties agree that Oslo Tingrett (Oslo City Court) shall have exclusive jurisdiction to settle any dispute between the parties.
14. NO RESPONSIBILITY FOR SUPPLIRES:
Global Tickets undertakes no responsibility for its suppliers' compliance with applicable law and/or the terms and conditions under which the tickets were acquired.
